China's AI Regulatory Landscape

China has taken a uniquely proactive approach to AI regulation, implementing binding regulations faster than most other jurisdictions. Rather than a single comprehensive AI law, China has enacted a series of targeted regulations addressing specific AI applications and risks.

Key regulations include the Algorithm Recommendation Regulation (March 2022), the Deep Synthesis (Deepfake) Regulation (January 2023), and the Interim Measures for the Management of Generative AI Services (August 2023). These regulations are mandatory for AI services operating in China and are enforced by the Cyberspace Administration of China (CAC).

Binding Rules for AI Services

Three Core Regulations

**Algorithm Recommendation Regulation (2022)** โ€” Requires transparency in algorithmic recommendation systems, including the ability for users to opt out of personalized recommendations. Providers must register algorithms with authorities and conduct security assessments.
**Deep Synthesis Regulation (2023)** โ€” Addresses deepfakes and AI-generated content. Requires clear labeling of AI-generated content, consent for using personal likenesses, and technical measures to prevent misuse.
**Generative AI Measures (2023)** โ€” Governs generative AI services (including large language models). Requires training data to be lawful, content to adhere to socialist core values, and providers to conduct security assessments before launching services. Users must register with real identities.
